Pomelo & The Ayala Foundation Partnership Terms & Conditions for Carina Disaster Relief

The Pomelo Disaster Relief Program is sponsored by Pomelo International, Inc., located at P.O. Box 193425, San Francisco, CA 94119 ("Sponsor"). This program is solely sponsored by Pomelo.

Program Period

The Program begins at 12:00 am Pacific Time ("PT") on July 29, 2024, and ends at 11:59 pm PT on August 4, 2024 ("Program Period").

Eligibility

To be eligible, participants must:

  • Be at least 18 years old
  • Be a legal resident of the United States, which includes Washington, DC
  • Have an existing Pomelo Mastercard in good standing, where good standing is defined by
    1. All required payments (minimum of one) made on time - not past due or delinquent at any time
    2. Open for purchases (not have been closed at any time, even if reopened)
  • Have a legitimate Pomelo transfer within the given Program Period.

Donation Details

Pomelo will donate 3% of the total amount of money sent through its platform to any recipient in the Philippines during the campaign period, up to a maximum of $18,000. These money transfers can be for any purpose as currently permitted in the Pomelo User Agreement and need to not be for disaster relief.

The total donation amount is capped at $18,000. Once the maximum donation limit is reached, no further donations will be made, regardless of additional transactions.

Donation Use

All funds donated by Pomelo to the Ayala Foundation, Inc. will be directed to support relief and recovery efforts for those affected by Typhoon Carina.

Conditions Applicable to Entry

Any use of robotic, repetitive, automatic, programmed, script, macro, or any other automated means or similar entry methods or agents (including, but not limited to, contest-entry services or multiple or different email addresses, identities, registrations, or logins) is prohibited and will void all entries submitted by that entrant if discovered by Sponsor. Entrants must have a Pomelo Account in their name. Each entrant may have only one Pomelo Account and only receive one promotional credit. Sponsor reserves the right in its sole discretion to disqualify any entry or entries at any time that in Sponsor’s opinion does not comply with these Official Rules. Sponsor is not responsible for lost, incomplete, damaged, illegible, late, or misdirected entries, or for errors in mechanical transmission, unavailability of phone lines or connections, cellular phone service, or any other technical malfunctions or inability to transmit messages or entries. Received entries become the property of Sponsor and will not be returned or acknowledged.

Disclaimer, Release, and Limit of Liability

SPONSOR MAKES NO WARRANTIES REGARDING THE PROGRAM. By participating, entrants agree to release and hold harmless Sponsor and its agents from any claims, injury, or damages arising from participation or the receipt or use of any credit. Sponsor is not responsible for technical, hardware, or software failures or other errors or interruptions of any kind.

Conditions of Participation

By participating in this Promotion, you agree to abide by these Official Rules and any decision Sponsor makes regarding this Promotion, which Sponsor will make in its sole discretion. This promotion is subject to the Sponsor’s Privacy Policy, available at https://www.pomelo.com/privacy.

Sponsor reserves the right to correct typographical, printing, or clerical errors in any Promotion-related materials and to make other changes that do not materially affect the substance of the Official Rules. Sponsor reserves the right to prohibit any entrant from participating in the Promotion if, at its sole discretion, Sponsor finds such entrant to be tampering with the entry process or the operation of the Promotion, or if such entrant shows a disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner the Sponsor determines to be not fair or equitable; (b) in an annoying, threatening, or harassing manner; or (c) in any other disruptive manner.

If a dispute arises regarding compliance with these Official Rules, Sponsor may consider, in its sole discretion, data reasonably available to Sponsor through information technology systems in Sponsor’s control, but Sponsor shall not be obligated to consider any data or other information collected from any other source. Neither the failure of Sponsor to insist upon or enforce strict performance of any provision of these Official Rules nor the failure, delay, or omission by Sponsor in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of Sponsor’s right to assert or rely upon any such provision or right in that or any other instance. If there is any conflict between any term of these Official Rules and any of the entry or marketing materials used in connection with the Promotion, the terms of these Official Rules will govern.

Pomelo Disaster Relief Donation Campaign Terms and Conditions

  1. Campaign Period: The donation campaign will run from 12:00 AM on July 29, 2024, to 11:59 PM on August 4, 2024 (PT).
  2. Donation Details: Pomelo will donate 3% of the total amount of money sent through its platform during the campaign period, up to a maximum of $18,000.
  3. Eligibility: All transactions sent through Pomelo during the campaign period are eligible for the donation calculation.
  4. Donation Cap: The total donation amount is capped at $18,000. Once the maximum donation limit is reached, no further donations will be made, regardless of additional transactions.
  5. Donation Use: All funds donated by Pomelo to the Ayala Foundation, Inc. will be directed to support relief and recovery efforts for those affected by Typhoon Carina.
  6. Transaction Calculation: The 3% donation will be calculated based on the total amount of money sent through Pomelo’s platform during the campaign period.
  7. Exclusions: Any fraudulent transactions or those deemed invalid by Pomelo will be excluded from the donation calculation.
  8. Announcement of Total Donation: Pomelo will announce the total amount donated within 14 days after the campaign ends.
  9. Changes to Terms: Pomelo reserves the right to modify or terminate the campaign at any time without prior notice. Any changes will be posted on our website.
